Terms of Service

Effective date: 24 October 2026

Agreeing to these terms

These Terms of Service are an agreement between you and Memoirs (“Memoirs”, “we”, “us” or “our”). They apply when you use the Memoirs app and this website (together, the “Service”). By creating an account or using the Service, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use Memoirs.

Who can use Memoirs

You must be at least 13 years old to use Memoirs. If you're under 18, you need your parent or guardian's permission, and they agree to these terms for you. You can't use Memoirs if we've banned you before, or if the law where you live doesn't allow it.

Your account

Give accurate information when you sign up, and keep your sign-in details safe. You're responsible for what happens on your account. If you think someone else has access to it, tell us straight away at memoirsapp254@gmail.com.

Your content

You own what you post: your photos, videos, voice notes, text and anything else you share (“your content”).

So that we can run Memoirs, you give us a worldwide, non-exclusive, royalty-free licence to store, copy, display and share your content with the people it's meant for, and to make technical changes like resizing or compressing it. This licence ends when you delete the content or your account, apart from copies we must keep for a short time for backups, safety or legal reasons.

Only post content you have the right to share. That includes having permission from the people in your photos and videos.

Posts you keep Private stay on your phone. We don't store or back them up, so if you delete the app or lose your phone, they're gone.

Community rules

Memoirs has zero tolerance for objectionable content and abusive users. Don't post content, or behave in a way, that:

Also don't try to break, overload or get around the security of Memoirs, access accounts or data that aren't yours, or collect information about other users.

Reports, moderation and appeals

You can report a post from its ••• menu, and our team reviews every report. If content breaks these terms, we may remove it, restrict your account (for example from posting or commenting) for a while or permanently, or ban your account. We'll let you know in the app.

If you think we got it wrong, you can appeal from that notification and a person will review it. We may also act to comply with the law or to protect someone's safety.

Our rights in Memoirs

Memoirs, including the app, its design, our name and logo, and the software behind it, belongs to us and is protected by law. These terms give you a personal, non-transferable right to use the app for its intended purpose. They don't give you any right to use our name, logo or design, or to copy, change, resell or reverse-engineer the app.

If you send us feedback or ideas, we can use them to improve Memoirs without owing you anything.

Third-party services

Memoirs works with services run by other companies, such as Sign in with Apple, Continue with Google and the App Store, and may link to other sites, such as the social profiles people add. We don't control those services, and their own terms and privacy policies apply when you use them.

Ending your account

You can delete your account at any time in Profile → Settings → Delete account. This permanently removes your profile and content, as described in our Privacy Policy.

We may suspend or end your access if you seriously or repeatedly break these terms, if we have to for legal reasons, or if we stop offering Memoirs. Sections that by their nature should continue, such as those on our rights, disclaimers and liability, still apply afterwards.

Disclaimer of warranties

We work hard to keep Memoirs running and your content safe, but the Service is provided “as is” and “as available”. To the extent the law allows, we don't promise that it will always be available, uninterrupted or free of errors, or that content won't be lost.

Places, ratings, contact details and spending that people share are their own experiences and opinions. Check things for yourself before relying on them, especially for travel or safety.

Limitation of liability

To the extent the law allows, Memoirs isn't liable for indirect, incidental or consequential losses, lost data or lost profits, or for content posted by other users. Nothing in these terms limits any rights you have under consumer protection laws that can't be limited.

Indemnity

If you break these terms or the law, or your content infringes someone else's rights, and that leads to a claim against Memoirs, you agree to cover the reasonable costs of that claim, to the extent the law allows.

Apple

If you downloaded Memoirs from the App Store, these terms are between you and Memoirs, not Apple. Apple isn't responsible for Memoirs or its content and has no obligation to provide support for it. Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them. Your use must also follow the App Store's terms.

Changes to these terms

We may update these terms as Memoirs changes. If we make important changes, we'll tell you in the app or by email before they take effect. If you keep using Memoirs after that, you accept the new terms.

Governing law

These terms are governed by the laws of Kenya, and any dispute will be handled by the courts of Kenya, unless the law where you live gives you the right to bring a claim locally.

General

These terms and our Privacy Policy are the whole agreement between you and Memoirs about the Service. If any part of these terms can't be enforced, the rest still applies. If we don't enforce a part of these terms straight away, we can still enforce it later. You can't transfer your rights under these terms to anyone else.
